Accounts
Users must use their own authorised account, keep credentials secure and only access information permitted by their role.
Acceptable use
Users must not break security, access another person’s private records without authority, interfere with the service, upload malicious content, impersonate others or use MathsExpress unlawfully.
Educational use
MathsExpress is a learning aid. Schools and teachers remain responsible for curriculum and important assessment decisions. AI and automated marking can be wrong and should remain reviewable.
School/student data
School and student content remains subject to the Privacy Policy, School Service Agreement and Data Processing Agreement. Storage does not transfer ownership of school/student content to MathsExpress.
Service changes and suspension
Reasonable maintenance and security changes may occur. Access may be restricted for security, serious misuse, unlawful activity or contractual reasons, with school coordination where appropriate.
Fees
Any paid school subscription, implementation fee or other charge must be stated in a written Order Form or School Service Agreement accepted by the school and the legal operator of MathsExpress. If no signed commercial document states a fee, these online terms alone do not create a new payment obligation. Applicable taxes, invoicing dates, renewal terms and approved discounts must be set out in that signed document.
Liability
Nothing in these terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded under applicable law. Any commercial liability cap, indemnity, insurance requirement or exclusion of indirect or consequential loss must be stated in the applicable signed School Service Agreement. If there is a conflict between these online terms and a signed School Service Agreement, the signed agreement controls to the extent of that conflict.
Governing law
Unless a signed School Service Agreement states otherwise, these online terms are governed by the laws of New South Wales, Australia, and disputes relating to these online terms are subject to the courts of New South Wales and courts entitled to hear appeals from them.
